Terms of Service — Nastrum POS

Please read these Terms of Service (“Terms”) carefully before using Nastrum POS. By creating an account, you are agreeing to be bound by these Terms. If you do not agree, do not use the Service.

1Definitions

  • “Nastrum”, “we”, “us”, “our” — refers to Nastrum, the operator of Nastrum POS
  • “Service” — the Nastrum POS mobile application, web console, and all related features
  • “You” / “Account Owner” — the individual or business that creates and holds the primary account
  • “Staff” — employees or team members invited to use the Service under your account
  • “Subscription” — a paid plan (Pro or Business) that grants access to additional features
  • “Content” — all data you enter into the Service including products, transactions, customer records, and business information

2Eligibility

By using the Service, you represent that:

  • You are at least 18 years of age
  • You have the legal authority to enter into these Terms on behalf of yourself or your business
  • You will use the Service only for lawful business purposes
  • You are not located in a jurisdiction where use of the Service is prohibited by law

3Account Registration

3.1 Account Creation

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password and account credentials
  • All activity that occurs under your account, including actions taken by staff members you invite
  • Notifying us immediately at support@nastrumpos.com if you suspect unauthorised access to your account

We are not liable for any loss resulting from unauthorised use of your account where you failed to keep your credentials secure.

3.3 One Account Per Business

Each business may maintain one primary account. You may invite staff members to operate under your account. Sub-accounts for staff are subject to the staff limits of your subscription plan.

3.4 Staff Accounts

When you invite staff members to your account, you confirm that:

  • You have the legal right to share that person's email address with us for the purpose of sending an invitation
  • You accept responsibility for the actions of your staff within the Service
  • You will promptly remove access for staff members who leave your employment

4Subscription Plans and Billing

4.1 Plans

Nastrum POS is offered on three plans:

Regional pricing (charged in local currency at equivalent rates):

  • India: Pro ₹749/month or ₹7,499/year — Business ₹2,499/month or ₹24,999/year
  • UAE: Pro AED 35/month — Business AED 109/month
  • Saudi Arabia: Pro SAR 35/month — Business SAR 109/month

All plans include all reports at no extra cost. Pricing may be updated from time to time with advance notice (see Section 4.7).

4.2 Billing

All payments are processed by Stripe, Inc. By subscribing to a paid plan, you authorise Stripe to charge your payment method on a recurring basis (monthly or annually as selected).

  • Monthly plans are billed on the same date each month
  • Annual plans are billed once per year on the subscription start date
  • Prices shown are exclusive of applicable taxes (GST, VAT, etc.) unless stated otherwise. Applicable taxes will be shown at checkout.

4.3 Free Trial

When you first invite a staff member on the Starter plan, you receive a one-time 30-day Pro trial at no charge. No credit card is required to start the trial.

  • The trial period begins on the date your first staff invite is created
  • At the end of the trial, your account reverts to Starter unless you upgrade to Pro or Business
  • Staff accounts created during the trial will be locked on the Starter plan if you do not upgrade
  • The trial can only be used once per business account — it cannot be restarted or transferred

4.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You can cancel at any time via the Billing section in the app (Settings > Billing > Manage Subscription).

You are responsible for cancelling your subscription before the renewal date if you do not wish to be charged for the next period.

4.5 Upgrades and Downgrades

  • Upgrades (e.g. Starter to Pro, or Pro to Business) take effect immediately. You are charged a prorated amount for the remainder of the current billing period.
  • Downgrades (e.g. Business to Pro) are handled through the Stripe Customer Portal. Downgrades take effect at the end of the current billing period. Existing data above the lower plan’s limits is preserved but new additions will be blocked until you return within plan limits.
  • Downgrading does not result in automatic deletion of branches, staff, or data created on a higher plan.

4.6 Refund Policy

  • Annual plans: If you cancel within 14 days of your annual payment, you are eligible for a full refund. After 14 days, no refund is issued for the remaining months.
  • Monthly plans: No refunds are issued for the current billing month. Cancellation stops future charges.
  • Free trial: No charge is made during the trial period.
  • Refunds, where applicable, are processed through Stripe to the original payment method within 5-10 business days.
  • To request a refund, email support@nastrumpos.com with your account email and subscription details.

4.7 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days advance notice of any price increase via email to your registered address and an in-app notice. If you do not cancel before the price change takes effect, you agree to the new price.

4.8 Failed Payments

If a payment fails, we will retry on subsequent days. If payment continues to fail after reasonable attempts, your account may be downgraded to Starter until a valid payment is made. We will notify you by email of any payment failure.

5Acceptable Use

Your use of the Service is also governed by our Acceptable Use Policy (nastrum.com/acceptable-use/nastrum-pos), which is incorporated into these Terms by reference.

In summary, you must not use the Service to:

  • Process transactions for illegal goods or services
  • Facilitate fraud, money laundering, or tax evasion
  • Resell or sublicense access to the Service to other businesses
  • Reverse-engineer, copy, or create derivative works of the app or its source code
  • Attempt to gain unauthorised access to our systems or other users' data
  • Violate any applicable local, national, or international law

6Your Content and Data

6.1 Ownership

You retain full ownership of all Content you enter into the Service — your products, transactions, customer records, and business data. We do not claim ownership of your Content.

6.2 License to Operate the Service

By using the Service, you grant us a limited, non-exclusive license to process and store your Content solely for the purpose of providing the Service to you. We do not use your Content for advertising, training AI models, or any other purpose.

6.3 Data Accuracy

You are responsible for the accuracy and legality of the data you enter. We are not responsible for errors in sales records, tax calculations, or inventory data arising from incorrect data entry.

6.4 Data Export

You may export your transaction data at any time in CSV format via Reports > Transaction History > Export. We recommend performing regular exports as part of your business backup practice.

6.5 Data on Account Termination

On account termination (whether by you or us), your data will be retained for 90 days during which you may request an export. After 90 days, data will be permanently deleted, except where retention is required by law.

7Intellectual Property

7.1 Our Property

Nastrum POS, including its design, source code, trademarks, logos, and all feature functionality, is owned by Nastrum and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described.

7.2 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or compensation.

8Privacy

Your use of the Service is subject to our Privacy Policy (nastrum.com/privacy/nastrum-pos), which is incorporated into these Terms by reference.

9Service Availability and Changes

9.1 Availability

We aim for high availability but do not guarantee uninterrupted service. The Service may be unavailable during maintenance windows, and we are not liable for downtime.

9.2 Offline Functionality

Nastrum POS is designed to function offline. Core POS functions (sales, receipts, stock updates) work without an internet connection. Data syncs to our servers when connectivity is restored.

9.3 Feature Changes

We may add, modify, or remove features at any time. We will provide reasonable advance notice for the removal of material features that affect paid plans.

10Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED
  • RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE
  • ANY DEFECTS IN THE SERVICE WILL BE CORRECTED

Tax calculations in the app are provided as a convenience tool only. You are responsible for verifying the accuracy of all tax calculations and for compliance with applicable tax laws in your jurisdiction.

11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NASTRUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12Indemnification

You agree to indemnify, defend, and hold harmless Nastrum, its officers, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising out of:

  • Your use of the Service in violation of these Terms
  • Your violation of any applicable law or regulation
  • Your Content, including claims by third parties regarding your business data
  • Actions taken by your staff members under your account

13Termination

13.1 Termination by You

You may close your account at any time by contacting support@nastrumpos.com. Cancelling your subscription (via Settings > Billing) ends future charges but does not delete your account or data.

13.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or the Acceptable Use Policy
  • Fail to pay subscription fees after reasonable notice
  • Engage in conduct that poses a risk to the Service or other users

We will provide notice where reasonably possible. For serious violations (fraud, illegal activity), we may terminate without notice.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases. Data export and 90-day data retention provisions (Section 6.5) apply.

14Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Disputes should first be addressed by contacting us at support@nastrumpos.com. We will make reasonable efforts to resolve disputes amicably.

If a dispute cannot be resolved informally, it shall be resolved by binding arbitration or in courts of competent jurisdiction in accordance with applicable law in your jurisdiction.

For European Union users: Nothing in these Terms affects your rights as a consumer under EU law, including your right to seek redress in your local courts.

15Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the “Last updated” date at the top of this page
  • Send a notification to your registered email address
  • Show an in-app notice on your next login, requiring you to accept the updated Terms before continuing

16General

  • Entire agreement: These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Nastrum regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • No waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
  • Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger or acquisition.
